Terms of Use

Welcome to MercuryPitch, a free, open-source vocal pitch-training app at mercurypitch.com (the “Service”). These Terms of Use (“Terms”) are a binding agreement between you and the MercuryPitch maintainers (“we,” “us”). Please read them.

1. Acceptance

By using the Service, you agree to these Terms and to our Privacy Notice. If you don’t agree, please don’t use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum digital-consent age in your country) to use the Service. If you’re under 18, use it only with a parent or guardian’s permission.

3. The Service is provided “as is”

MercuryPitch is offered free of charge, “as is” and “as available,” with no warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of pitch detection, or uninterrupted availability. You use it at your own risk.

4. Your responsibility for audio and other content

You are solely responsible for any audio, music, or other content you provide to the Service (your “Content”), including any track you use with the optional stem-separation (karaoke) feature.

You represent and warrant that, for every piece of Content you provide, you either own it or have all the rights, licenses, and permissions necessary to use it with the Service. Do not provide audio you don’t have the right to use. You are responsible for how you use any results, including any instrumental or vocal stems you create.

To provide a feature you request, you grant us a limited, non-exclusive, royalty-free license to use, store, and process your Content only as needed to deliver that feature to you, and for no other purpose. We do not claim ownership of your Content or of any results, and we do not use your Content to train or fine-tune any machine-learning models.

5. Acceptable use

You agree not to use the Service to:

  • provide, process, or share content you don’t have the rights to, or to infringe anyone’s copyright or other rights;
  • do anything illegal, or to create content that is unlawful, harmful, harassing, or abusive;
  • pull audio from streaming services or other sources in violation of their terms — provide your own files;
  • disrupt, overload, scrape, or attack the Service or other users, or circumvent any technical limits;
  • misuse community features (see Section 7).

We may suspend or limit access if you break these rules.

6. Intellectual property

The MercuryPitch software is open source under the GNU AGPL-3.0 license; you’re free to use, study, modify, and self-host it under that license (see our repository). These Terms cover the hosted Service at mercurypitch.com and do not limit your rights under AGPL-3.0. Our name and logo remain ours. Your Content stays yours.

7. Community content

If you share melodies, scales, a display name, leaderboard scores, or join peer-to-peer “jam” sessions, you’re responsible for what you share and how you behave. Don’t post infringing, unlawful, or abusive content, and treat other users with respect. We may remove community content or revoke access for violations.

8. Privacy

How we handle data is described in our Privacy Notice. In short, live pitch detection runs on your device and your microphone audio stays in your browser.

9. Copyright complaints

We respect intellectual-property rights. If you believe content on the Service infringes your copyright, contact us at copyright@mercurypitch.com with: the work concerned, where it appears, your contact details, and a statement that you have a good-faith belief the use is unauthorized. We will review and remove infringing content where appropriate.

10. Limitation of liability and indemnity

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your Content or your use of the Service. Because the Service is free, our total liability to you will not exceed USD 50.

You agree to defend and indemnify us against any third-party claim arising from your Content, your use of the Service, or your breach of these Terms.

11. Changes

We may update these Terms. If we make material changes, we’ll update the date above and, where reasonable, give notice. Continued use means you accept the new Terms.

12. Governing law and contact

These Terms are governed by the laws of [your jurisdiction], without regard to conflict-of-law rules. Questions: hello@mercurypitch.com.
